Breaking: Katherine Jackson requests to join Bain, El-Amin case against MJ Estate
http://dailymichael.com/lawsuits/mj-...inst-mj-estate

On February 2nd, Katherine’s lawyers filed a motion to join Quadree El-Amin, Broderick Morris, Aldean King and Raymone Bain lawsuit against Michael Jackson Estate. I reported about this lawsuit earlier at the “Who owns the Michael Jackson Company?” blog post in detail.

In short; El-Amin, Morris, King and Bain claimed combined 15% ownership at the Michael Jackson Company. They claimed Michael signed one page document at 3 AM at a Tokyo hotel room. This document also listed 10% ownership interest for Katherine Jackson.

MJ Estate argued the Michael Jackson Company’s incorporation documents only listed Michael as the sole member. Bain and King in their creditor claims filed after Michael’s death did not mention any ownership at the MJ Company. These ownership claims were only raised in 2012 – 2014. This made MJ Estate to question the credibility of the claims.

In anticipation of ownership claims, MJ Estate filed an 850 motion with the probate court asking the court to determine the ownership of MJ Company. This was followed by a civil lawsuit by El-Amin, Morris, King and Bain. After disagreements about the competing actions, court decided Estate’s 850 motion takes precedent.

Attempts to stop Estate’s 850 motion included a declaration from Randy Jackson around December 2015 questioning validity of Michael’s Will. A bench trial happened between December 2015 and February 2016. There have been multiple briefs following the trial testimony as recent as at November 2016. Judge Stratton has yet to rule about the 850 motion.

Document : Katherine Jackson's request to join the case https://www.scribd.com/document/3390727 ... -Amin-Bain

On February 2nd, 2017 Katherine filed a request to join this lawsuit. Documents stated that Katherine wants to protect her 10% ownership interest in the Michael Jackson Company. The document stated that Katherine learned about this case from other people (most probably Randy Jackson) and she was unable to intervene until now due to sensitive reasons (most probably due to the elder abuse claims). The documents also included a declaration by Katherine Jackson signed at London, England.

The significance of this claim is that Michael Jackson Company was used in TII deals (both the concert and the movie). TII movie grossed over $250 Million and combined revenues exceeded $500 Million. If plaintiffs succeed in this lawsuit, Katherine can get 10% of these revenues while El-Amin, Morris, King and Bain can get the 15%. Estate will be left with 75%.

In an 100% Michael / Estate ownership, the revenues goes to Estate which is used and/or put aside for the beneficiaries including Katherine. So Katherine benefits either way. However a 10% ownership would mean getting more money directly for Katherine.

It is too early to say what will happen. Personally I would expect the judge to grant Katherine’s request and allow her to join the case as a plaintiff. However the 850 motion hasn’t been decided yet. If the court rules that Michael was the sole owner of the Michael Jackson Company, Katherine’s request to join to the civil case will become moot. Hearing is set for April 19, 2017.

Katherine Jackson Seeks to Join Lawsuit Against Michael Jackson Estate

Michael Jackson's mother Katherine Jackson has filed legal paperwork to join a lawsuit against the executors of the King of Pop's estate over a stake of ownership in the Michael Jackson Company.

In the initial lawsuit, which has occupied the courts since 2013, former Jackson associates Broderick Morris, Qadree El-Amin, Adean King, and Raymone Bain claim that the singer promised them a combined 15-percent stake in his company.

While Katherine Jackson has a 10-percent ownership and the role of officer in the Michael Jackson Company following her son's 2009 death, in a motion filed to the California Superior Court in early-February, she asserts that important estate matters have been made without her input.

The defendants, John Branca and John McClain, are the executors of Jackson's estate. Lawyers for Branca did not immediately respond to a request for comment.

"Although I am a principal beneficiary of the Michal Jackson Family Trust, I was not informed by the Executors of Mr. Al-Amin's December 20, 2012 letter; nor did the Executors keep me informed on the progress of this action or the progress of the Estate of Jackson case," Katherine Jackson wrote in her brief.

El-Amin, a "close friend and confidant of Michael Jackson," said in a statement, "Mrs. Jackson deserves her ownership of The Michael Jackson Company and to make decisions on major company issues. It's what Michael wanted—he trusted her more than anyone. She was left 40 percent of the Michael Jackson Estate and can make Branca and McClain pay her what she is entitled to and demand to be involved in decision making—if they don't she has the power to fire them. They're an amazing disgrace."
At the crux of Morris, El-Amin, King and Bain's argument against the Jackson estate is a document from May 1st, 2006 meeting in Tokyo with the King of Pop. At the meeting, the first of the "Board of Directors of the Michael Jackson Company," the singer, as chairman of the board, gave himself a 75-percent stake in his own company, with Katherine Jackson and Bain receiving 10-percent. El-Amin, King and Morris were all handed a 1.6-percent share.

Jackson also expressed his desire for his son Prince Jackson to take over as chairman when he completed school.
In the lawsuit, the four plaintiffs argue that Branca and McClain "repudiated" their ownership stake upon Jackson's death.
An April 19th hearing has been set in Los Angeles to determine whether Katherine Jackson can become involved with the lawsuit.
Earlier this month, Katherine Jackson was granted a restraining order against her nephew Trent Lamar Jackson following accusations of elder abuse.

MICHAEL JACKSON
Victory for Estate ...
JUDGE TELLS EX-BIZ PARTNERS TO BEAT IT
3/27/2017 5:23 PM PDT
EXCLUSIVE
Michael Jackson's former business partners tried to get a multi-million dollar slice of the pie after MJ's death, but a judge just told them to kick rocks ... TMZ has learned.
Three of the 4 plaintiffs claim they had a meeting with Michael in a Tokyo hotel room on June 1, 2006, and MJ promised them shares of his company. They claim Michael wanted to reward them for their loyalty at a time when the music biz had turned its back on him.
The plaintiffs include MJ's former publicist Raymone Bain and Quadree el-Amin -- a former manager for Boyz II Men -- but they have a big problem. According to docs, there was no written contract, it was an oral agreement. Monday in L.A. the judge said their story lacked credibility, and they were too damn late.
They didn't file their claim until 2014 -- 5 years after Michael's death. The judge said if they really did strike this mega deal -- 1.6% each for 3 of them, and 10% for the 4th -- why not try to get it while Michael was still alive? Not to mention the deadline for such a claim was 2010.
In other words: Too Bad.

Howard Weitzman, lawyer for the MJ Estate, tells TMZ, "This was a frivolous and outrageous case and these claimants got what they deserved -- which was nothing."
